1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of the website frontterritorycontract.co (the "Site") and the freight, trucking and logistics services (the "Services") provided by PLUMB TIRED LLC ("PLUMB TIRED", "we", "us" or "our"). By accessing the Site or requesting our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our Services.

2. Our Services

PLUMB TIRED LLC provides full truckload (FTL), less-than-truckload (LTL), expedited, flatbed and oversized, warehousing and distribution, and intermodal freight services throughout the 48 contiguous United States. Details of these services are described on the Site and confirmed in each booking.

3. Eligibility & Use of the Site

You must be at least 18 years old and capable of entering into a binding contract to use the Site or our Services. You agree to use the Site lawfully and in a manner that does not infringe the rights of others or interfere with the operation of the Site. You agree not to attempt to gain unauthorized access to the Site, its servers, or systems connected to it.

4. Quotes & Pricing

Quotes provided through the Site or by our team are estimates based on the information you provide. A quote is not a binding contract until a booking is confirmed in writing and accepted by both parties. Final pricing may vary based on actual weight, dimensions, distance, equipment, accessorial services, fuel surcharges and other factors disclosed at the time of booking. All rates are in United States dollars unless stated otherwise.

5. Bookings & Service Agreements

When you book a shipment, you agree to provide accurate and complete information about the cargo, pickup and delivery locations, and the parties involved. You are responsible for ensuring the freight and packaging comply with applicable laws and regulations. A confirmed booking creates a contractual relationship between you and PLUMB TIRED LLC, and the terms of that booking (including any bills of lading, rate confirmations and accessorial agreements) apply in addition to these Terms.

6. Shipping Terms

Our operational terms, including transit times, carrier responsibilities, detention, refusal and claims procedures, are set out in our Shipping Policy. By booking a shipment, you agree to those terms.

7. Payment & Billing

Payment terms are set out in your quote and in our Billing & Refunds Policy. Unless otherwise agreed, invoices are payable within the terms stated on the invoice. Late payments may incur charges as described in that policy. PLUMB TIRED LLC may suspend services for overdue accounts.

8. Liability & Insurance

PLUMB TIRED LLC maintains liability and cargo insurance as required by applicable federal and state regulations. The extent of our liability for loss or damage to cargo is governed by the applicable transportation contract, the bill of lading, and applicable law (including, where applicable, the Carmack Amendment, 49 U.S.C. § 14706). Our Shipping Policy describes claim filing procedures and time limits.

9. Prohibited Conduct

• Using the Site for any unlawful purpose or in violation of these Terms.
• Misrepresenting cargo, packaging, value or other shipment details.
• Attempting to interfere with, disrupt or damage the Site.
• Attempting to reverse engineer, scrape or harvest data from the Site.
• Uploading or transmitting malicious code, viruses or harmful content.

10. Intellectual Property

The Site, including its text, graphics, logos, icons, images, audio clips, data, and software, is the property of PLUMB TIRED LLC or its licensors and is protected by copyright, trademark and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any part of the Site without our prior written consent. The name "PLUMB TIRED LLC", our logo and related marks are trademarks of PLUMB TIRED LLC.

11. Third-Party Links

The Site may contain links to third-party websites, including content hosted on external platforms such as Google Fonts and stock image providers. We do not control and are not responsible for the content or practices of any third-party website. Your use of third-party sites is subject to their own terms and privacy policies.

12. Disclaimers

The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. While we strive to keep the Site accurate and up to date, we do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that information on the Site is complete or current. 13. Limitation of Liability

To the maximum extent permitted by law, PLUMB TIRED LLC and its officers, directors, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or related to your use of the Site or the Services. Any liability we may have for direct damages is limited to the amount you actually paid us for the specific shipment giving rise to the claim, or as otherwise provided in the applicable transportation contract, whichever is less.

14. Indemnification

You agree to indemnify and hold harmless PLUMB TIRED LLC and its affiliates, officers, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your provision of inaccurate or non-compliant cargo information.

15. Termination

We may suspend or terminate your access to the Site or our Services at any time, with or without cause and with or without notice, where permitted by law. Termination does not affect obligations that have accrued, including payment obligations for shipments already in transit or completed.

16. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Colorado and applicable federal law of the United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site or Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Colorado. Where applicable law provides otherwise, that law shall prevail.

17. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the "Effective" date at the top of this page. Your continued use of the Site or Services after changes take effect constitutes your acceptance of the revised Terms.
